المدافعون عن حقوق الإنسان هم أولئك الذين يعملون بإنسانية، ويخدمون الإنسانية، ويساهمون في إخراج أفضل ما في الإنسانية. وجودهم أساسي في حياتنا اليومية، فهم يعملون كي تكون حكوماتنا أكثر شفافية وقابلية للمساءلة، ولتصبح بيئتنا أنظف وأكثر أماناً، ومدارسنا وأماكن عملنا أكثر عدلاً، ومستقبلنا أكثر استدامة. بينما يتصدى المدافعون عن حقوق الإنسان للسلطة والامتياز والتحيز، فإنهم يواجهون باستمرار مجموعة واسعة من المخاطر والتهديدات، منها ما يكون موجهاً ضد منظماتهم وعائلاتهم وأصدقائهم وأحبائهم. وعلى الرغم من مساهمات المدافعين الهامة، لا تزال بعض الحكومات والجهات الفاعلة من غير الدول تسعى إلى إسكاتهم إذا قاموا بفضح الظلم أو طالبوا بالمحاسبة.
إن ولاية المقرر الخاص المعني بحالة المدافعين عن حقوق الإنسان جزء لا يتجزأ من حمايتهم والاعتراف بهم على الصعيد العالمي. تجمع الولاية المعلومات المتعلقة بوضع المدافعين حول العالم وتستجيب لها، وتشارك بشكل بنّاء مع الحكومات والجهات الفاعلة من غير الدول، وتقدم توصيات الخبراء لتعزيز التطبيق الفعال للإعلان المتعلق بحق ومسؤولية الأفراد والجماعات وهيئات المجتمع في تعزيز وحماية حقوق الإنسان والحريات الأساسية المعترف بها عالمياً (الإعلان الخاص بالمدافعين عن حقوق الإنسان).
يصادف عام 2023 مرور خمس وعشرين سنة على اعتماد الجمعية العامة للأمم المتحدة الإعلان الخاص بالمدافعين عن حقوق الإنسان، والذي كان نقطة حاسمة في تاريخ حقوق الإنسان. أوضح الإعلان كيفية تطبيق قانون حقوق الإنسان الحالي على حالة المدافعين عنه، واعترف بأهمية وشرعية نشاط حقوق الإنسان، والحاجة إلى حمايته وحماية المدافعين عنه. من الملائم أن تتزامن هذه الذكرى السنوية الكبرى مع الذكرى الخامسة والسبعين للإعلان العالمي لحقوق الإنسان، مما يعكس الدور المتكامل الذي يلعبه المدافعون في إعمال حقوق الإنسان العالمية.
في عام 2022، أكد مجلس حقوق الإنسان من جديد أهمية الإعلان المتعلق بالمدافعين عن حقوق الإنسان وتطبيقه بشكل كامل وفعال، وشدد على أن تعزيز الاحترام والدعم والحماية لأنشطة المدافعين عن حقوق الإنسان (بمن فيهم المدافعات عن حقوق الإنسان) أمر ضروري لكفالة التمتع بهذه الحقوق عموماً، سواء في حالات النزاع أو ما بعده. في عام 2021، أقرت الجمعية العامة بموافقة 85 دولة مشارِكة قراراً يعترف بالدور الهام والشرعي الذي لعبه المدافعون عن حقوق الإنسان في الاستجابة لوباء كوفيد 19، فضلاً عن التحديات التي واجهتهم نتيجة لذلك.
ستنظر الدول خلال الدورة 52 للمجلس في قرار تمديد ولاية المقرر الخاص لمدة ثلاث سنوات. هذه فرصة مهمة للدول والمجلس لإظهار دعمهم واعترافهم بالدور الجوهري الذي يلعبه المدافعون عن حقوق الإنسان لضمان تمتع جميع الناس بالحرية والكرامة والعدالة والمساواة.
لذلك تحث منظماتنا جميع الدول على دعم القرار الذي يجدد ولاية المقرر الخاص للأمم المتحدة المعني بالمدافعين عن حقوق الإنسان من خلال:
- المشاركة الإيجابية في المفاوضات حول القرار.
- تقديم رعاية مشتركة مبكرة لنص القرار.
- مقاومة أي محاولات لإضعاف الولاية أو التزامات الدول.
- دعم الإجماع على تجديد الولاية.
