The mentioned report aims to study and share a range of domestic legislative, investigative, and prosecutorial practices in order to address multiple challenges, impediments and obstacles standing in the way of effective accountability and justice for victims and survivors, and to allow societies to heal and recover.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/p>\n<p style=\"text-align: justify;\">On 24 November 2022, in response to the Special Rapporteur&#8217;s call, STJ and twelve NGOs<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> jointly-submitted a paper that addresses the topic in question in the context of both the victims\u2019 rights and the applicable legal framework in Syria, mainly through the lens of the recently enacted Anti-torture Law No.16 of 2022,<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> and the interlinked legislation.<\/p>\n<p style=\"text-align: justify;\">The submission addresses the regulatory framework of torture and ill-treatment in Syrian Law including the Military Penal Code promulgated by Legislative Decree 61 of 1950,<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> the General Penal Code No.148 of 1949,<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> the Prison System Law No. 1222 of 1929, and the Anti-torture Law No.16 of 2022.<\/p>\n<p style=\"text-align: justify;\">Moreover, the submission discusses the elements of human rights-compliant investigations and prosecutions, its challenges, impediments, and obstacles. It argues that Syrian domestic law does not ensure effective accountability and justice for victims and survivors of torture and ill-treatment crimes for several reasons:<\/p>\n<ul style=\"text-align: justify;\">\n<li>The law does not criminalize all forms of ill-treatment known to take place in detention centers in Syria.<\/li>\n<li>The law does not guarantee justice and comprehensive reparation for the victims.<\/li>\n<li>The new anti-torture law, like any new aggravated criminal law, will not apply retroactively to acts that occurred before the date of its issuance, which leaves the victims&#8217; rights of previous violations in jeopardy.<\/li>\n<li>The law does not put an end to the impunity provided to members of the military, internal security forces and general intelligence.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">According to the call, the submission will be presented to the 52nd session of the Human Rights Council in March 2023 and will be published on the mandate\u2019s webpage.<\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> \u201cCall for input to a report: The duty to investigate crimes of torture in national law and practice\u201d, OHCHR.
